The legislative and regulatory framework applicable to data protection in France has been established by the Act No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties (referred to below as “Data Protection Act” or “DPA”), as amended on 6 August 2004, in accordance with the European Directive of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (referred to below as the “EC Directive”) . As a result, the French and European personal data legislations are very similar.
